  1. 1.What are the requirements that contestants should meet to vie for the positions of Council Chair and Council Member seats have?

    Chairman of the Council

    a. Is registered as a Member of the Kenya Institute of Supplies Management under section 3A (2) (a &b) with at least five years’ experience, elected by the members of the Institute of the Supplies Practitioners Management Act.
    b. Has Paid the prescribed fee under section 3A (4) of the Act.
    c. Holds a valid practising license for the year 2022.
    d. Has at least five years’ experience in Supply Chain;
    e. Has not been convicted of an election offence under section 22 of the Regulations and;
    f. Meets requirements of leadership and integrity set out under chapter 6 of the Constitution of Kenya.
    Council Member
    a. Is registered as a Member of the Kenya Institute of Supplies Management under section 3A (2) (a &b) of the Supplies Practitioners Management Act.
    b. Has Paid the prescribed fee under section 3A (4) of the Act.
    c. Holds a valid practising licence for the year 2022.
    d. Has not been convicted of an election offence under section 22 of the Regulations and;
    e. Meets requirements of leadership and integrity set out under chapter 6 of the Constitution of Kenya.

  2. 2. Who is Eligible to Vote during the KISM council Elections 2023 ?

    Fully paid-up Member for the year 2022 as prescribed under section 3A (4) of the Act.
    The only Members who will be entitled to vote are prescribed in Section 4(1A) of the SPMA which prescribes that:
    “The Chairman and the members of the Council referred to in paragraph (d) shall be elected by the members of the Institute specified in section 3A(2)(a) and (b) in the manner prescribed by regulations”. (FKISM & MKISM)

  3. 3. What guides KISM Council Elections

    The Council Elections are guided by the Supplies Practitioners Management Act, 2007 and Supplies Practitioners Management (Elections) Regulations of 2022.

  4. 4. What documentations does one require to meet the requirements of leadership and integrity set out under Chapter 6 of the Constitution of Kenya?

    i. Valid and current Certificate of Good Conduct from the Directorate of Criminal Investigation.
    ii. Clearance Certificate from the Higher Education Loans Board for the current duration.
    iii. Valid and current Tax Compliance Certificate from KRA.
    iv. Clearance from Ethics and Anti-Corruption Commission.
    v. A Clearance Certificate from an approved Credit Reference Bureau CRB (Valid within 24hrs from the date of acquisition)

  5. 5. What is the mandate of the Dispute Resolution Committee (DRC)

    The DRC shall address disputes arising from:
    a) The publication of the register of members under Regulation 9;
    b) The nomination of candidates for the election;
    c) The voting process; and
    d) The outcome of the election.

    The Committee shall determine a dispute before it within ten days from the date the dispute is lodged.
    A person aggrieved by a decision of the Committee under this regulation may appeal to the High Court.

  6. 6. What is the Scope of Dispute one can lodge to the Dispute Resolutions Committee?

    Any Member of the Kenya Institute of Supplies Management as provided in Section 3A(2) (a) & (b) of Supplies Practitioners Management Act, 2007 may lodge a dispute to the Dispute Resolution Committee in accordance with Regulation 6(3) of the Council Elections Regulations, 2022 on the following areas in the electoral processes:
    a) The publication of the register of members;
    b) The nomination of candidates for the election;
    c) The voting process; and
    d) The outcome of the election.

  7. 7. What are the Powers of DRC

    a) call for documents;
    b) issue summons;
    c) To affirm or vary a decision;
    d) to nullify the candidature of a candidate;
    e) to award costs; and
    f) to exercise any other power for the effective discharge of its functions.

  8. 8. What is the role of IEBC in this Election

    The IEBC is the prescribed electoral body under the Regulations. They shall:
    a. receive and consider nomination papers of aspirants;
    b. approve qualified aspirants to contest in the election;
    c. supervise the casting of votes;
    d. determine, declare and publish the results of the election; and accredit a person as an agent or observer for purposes of the election.

  9. 9. When will the elections be held

    a) The elections shall be held between every second Wednesday and second Friday in January in every third year.
    b) Commencing at 12:00 noon on the second Wednesday and concluding at 12:00 noon on the second Friday.
    c) Voting at an election under the Regulations shall be by electronic means
    d) The elections will be held on 11th January 2023 from 12.00pm to 13th January 2023 12.00pm.

  10. 11. Can a candidate withdraw from vying?

    A candidate may within thirty days before the date of the election, withdraw his candidature in writing to the electoral body.
    The electoral body shall notify the members of Institute of the withdrawal of candidature received pursuant to sub regulation (1) and publish a notice of withdrawal of candidature on the Institute’s website, within forty-eight hours of receipt of the withdrawal

  11. 12. What happens when a candidate is unopposed

    Where only one candidate declares interest for any vacant position in the Council, such candidate shall be deemed to have been duly elected.
    The electoral body shall, issue a certificate of election to the candidate elected unopposed under sub regulation (1).

  12. 13.When is the Campaign period commencing

    The campaign period shall commence sixty days before the date of the election and terminate forty-eight hours before the date of the election.
